1. Service
MenuSafe (operated by Roman Rusavskyi, individual entrepreneur (ФОП) registered in Ukraine — see the Legal Notice) provides digital QR menus for restaurants, including allergen labelling (EU Reg. 1169/2011), AI-assisted translation, staff allergen sheets and related tools. Payments for paid plans are processed by our reseller Paddle (see section 3).
2. Accounts & plans
- You must provide accurate account information and keep your credentials safe.
- Free and paid plans differ in limits (dishes, languages, features) as described on the pricing page. Plan limits, including daily AI usage quotas, may be enforced technically.
3. Billing, subscriptions & refunds
- Merchant of Record. Our order process and payments for paid plans are conducted by Paddle.com Market Ltd(“Paddle”), our authorised reseller and Merchant of Record. When you purchase a paid plan, your contract for that purchase is with Paddle. Paddle handles the payment, issues the invoice/receipt and collects and remits any applicable VAT or sales tax. Paddle’s own terms and privacy notice additionally apply to the transaction.
- Recurring subscription. Paid plans are billed as an automatically recurring subscription (monthly, unless stated otherwise) at the price shown at checkout, until you cancel. Your chosen payment method is charged at the start of each billing period.
- Cancellation. You can cancel at any time from your billing settings or via the link in your Paddle receipt. On cancellation your paid features remain active until the end of the current paid period, after which the account reverts to the Free plan. Menu content is not deleted by a downgrade.
- Refunds & withdrawal. Statutory consumer rights, including any EU right of withdrawal, remain unaffected. Refund requests are handled through Paddle as Merchant of Record — see our Cancellation & Refund Policy.
- Price changes. We may change plan prices; changes to a running subscription are announced with reasonable notice and take effect from the next billing period.
4. Your content & allergen responsibility
- You retain all rights to the menu content you upload.
- Allergen, additive and nutrition information is entered and maintained by the venue. The venue alone is responsible for its accuracy and its compliance with EU Reg. 1169/2011 and local law. MenuSafe provides tooling (reference lists, confirmation workflow, staff sheets) but does not verify food composition.
- AI-generated translations and descriptions must be reviewed by the venue before relying on them.
5. Acceptable use
No unlawful content, no infringement of third-party rights, no attempts to disrupt the service, probe other tenants’ data or circumvent plan limits and rate limits.
6. Availability & liability
The service is provided without a guaranteed uptime level. We are liable without limitation for intent and gross negligence; for slight negligence only in case of breach of essential contractual obligations and limited to the typical foreseeable damage. We are not liable for damage resulting from incorrect allergen data entered by venues.
7. Termination
You may delete your account at any time; we may terminate accounts that violate these terms. Upon deletion, your data is removed as described in the Privacy Policy.
8. Changes
We may update these terms; material changes will be announced in the product with reasonable notice. Continued use after the effective date constitutes acceptance.
9. Governing law
The law of Ukraine applies. Where the buyer is an EU consumer, the mandatory consumer protection rules of their country of residence remain unaffected, and the payment contract with Paddle (Merchant of Record) is governed by Paddle’s own terms.
